Federal ALB regulations are found in the Code of Federal Regulations at 7 CFR 301.51. You can review periodic regulatory updates by referring to the eCFR in Title 7, Subtitle B, Chapter III, Part 301, Subpart H, or by reviewing the Federal Orders in the sections below.
regulated area
The regulated area includes Worcester County, Massachusetts. Nassau and Suffolk counties on Long Island, New York; Clermont County, Ohio. Charleston and Dorchester Counties, South Carolina.
Regulated items
ALB regulated articles (156.41 KB) include:
Asian longhorn beetle (Anoplophora glabripennis) at any stage of growth Firewood from all hardwood species Live, dead, and cut wood, including seedlings, logs, green wood, stumps, roots, branches, and debris smaller than 0.5 inch Diameter details of the genus listed in Appendix 1 for all host material that has been or has fallen.
Regulated facilities
Facilities operating within an ALB quarantine area must comply with all ALB federal and state regulations. Regulated facilities include:
Landscape contractors Tree pruners Tree removal companies Land developers Firewood distributors Pallet distributors Nurseries Sanitation workers, other municipal or regional services and related contractors
Enforcement of regulated facilities
Regulated facilities must enter into a compliance agreement or obtain a permit from an agency inspector before moving permitted ALB-regulated items outside of the quarantine area. Regulated facilities are subject to penalties if they are not in compliance and do not follow ALB regulations.
Seedlings within regulated areas are subject to inspection. Plant material infected with ALB must be chipped according to ALB regulations. Uninfected host material in the nursery trade is allowed to leave the regulated area if accompanied by a test certificate and an approved permit.
Traceback and traceforward inspection
If a new ALB infestation is confirmed, follow-up testing will be performed to identify the possible source of infection. These tests begin at the epicenter in the core region and work outward from there.
Trace-forward testing is performed to determine if infected host material has been moved outside the regulated area. These inspections begin with regulated facilities located within or operating within the regulated area. Once these facilities are identified, the investigation protocols used to investigate high-risk facilities will be applied.
quality assurance
Regulatory officials will conduct spot checks on the removal of ALB-positive host material to ensure that contractual obligations are met.
